{"id":17038,"date":"2016-07-07T07:36:28","date_gmt":"2016-07-07T10:36:28","guid":{"rendered":"http:\/\/www.isletasnoticias.com.ar\/?p=17038"},"modified":"2016-07-07T07:36:28","modified_gmt":"2016-07-07T10:36:28","slug":"las-10-claves-que-hay-que-saber-antes-de-firmar-un-contrato-de-alquiler","status":"publish","type":"post","link":"https:\/\/informelitoral.com.ar\/las-10-claves-que-hay-que-saber-antes-de-firmar-un-contrato-de-alquiler\/","title":{"rendered":"Las 10 claves que hay que saber antes de firmar un contrato de alquiler"},"content":{"rendered":"<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>La falta de informaci\u00f3n junto a organismos de control que no controlan\u00a0son las principales causas por las que la relaci\u00f3n entre el inquilino, la inmobiliaria y el propietario est\u00e1 repleta de zonas grises. \u00bfQu\u00e9 est\u00e1 bien y qu\u00e9 esta mal? \u00bfQu\u00e9 es legal y qu\u00e9 no? \u00bfD\u00f3nde empiezan los derechos del inquilino y d\u00f3nde terminan?.<a href=\"http:\/\/www.isletasnoticias.com.ar\/%77%70%2d%63%6f%6e%74%65%6e%74\/uploads\/2016\/07\/alquiler_4.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-17039 size-full\" src=\"http:\/\/www.isletasnoticias.com.ar\/%77%70%2d%63%6f%6e%74%65%6e%74\/uploads\/2016\/07\/alquiler_4.jpg\" alt=\"alquiler_4\" width=\"676\" height=\"376\" srcset=\"https:\/\/informelitoral.com.ar\/%77%70%2d%63%6f%6e%74%65%6e%74\/uploads\/2016\/07\/alquiler_4.jpg 676w, https:\/\/informelitoral.com.ar\/%77%70%2d%63%6f%6e%74%65%6e%74\/uploads\/2016\/07\/alquiler_4-300x167.jpg 300w\" sizes=\"auto, (max-width: 676px) 100vw, 676px\" \/><\/a><\/strong><\/p>\n<p class=\"element element-paragraph\">Ya sea por la primera vez o una renovaci\u00f3n del contrato, alquilar un\u00a0<strong>departamento o una casa<\/strong> es una realidad que enfrentan los argentinos en un contexto nada f\u00e1cil: en la mayor\u00eda de los casos, los valores se actualizan cada seis meses por una inflaci\u00f3n que cerrar\u00e1 el a\u00f1o por encima del 30%.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>Gervasio Mu\u00f1oz<\/strong>, referente de la organizaci\u00f3n Inquilinos Agrupados de la ciudad de Buenos Aires, asegur\u00f3 en di\u00e1logo con <em>Infobae <\/em>que el C\u00f3digo Civil es el que mayormente regula en el <strong>alquiler de vivienda \u00fanica<\/strong>, y destac\u00f3 los 10 puntos m\u00e1s importantes a tener en cuenta antes de firmar.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>1. \u00bfCu\u00e1nto se paga de comisi\u00f3n?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Las inmobiliarias deben cobrar <strong>un mes de comisi\u00f3n<\/strong>, que equivale a un 4,15% del valor total del contrato. Esto est\u00e1 determinado por el art\u00edculo 57 de la Ley 2.340 de la Ciudad de Buenos Aires.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>2. Si hay inter\u00e9s en una vivienda, \u00bfse se\u00f1a o se reserva?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Siempre hay que se\u00f1ar, porque la reserva no est\u00e1 legislada. Si el propietario o la inmobiliaria luego se arrepienten de poner en alquiler la vivienda, deben reintegrar el doble de esa se\u00f1a.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>3. \u00bfCu\u00e1nto dura un contrato de alquiler de\u00a0vivienda \u00fanica?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Est\u00e1 prohibido firmar contratos para alquiler de vivienda por menos de dos a\u00f1os. Esto es as\u00ed a nivel nacional seg\u00fan el art\u00edculo 1198 del C\u00f3digo Civil y Comercial. Es por eso que el propietario no puede rescindirlo antes.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>4.\u00bfQu\u00e9\u00a0es lo primero que un inquilino debe hacer al llegar a la vivienda?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Durante los primeros 15 d\u00edas, es importante hacer un inventario de todo lo que hay o falta en la vivienda, m\u00e1s all\u00e1 de que est\u00e9 especificado en el contrato (como por ejemplo, el modelo y marca del aire acondicionado). Luego hay que entregar una copia al propietario y otra a la inmobiliaria.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>5. \u00bfQui\u00e9n paga los arreglos y mantenimientos?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Muchas veces no se cumple, pero la obligaci\u00f3n de mantener y arreglar la vivienda es del propietario. Esto es as\u00ed siempre que se cumplan dos condiciones: el buen uso por parte del inquilino o se deteriore por el paso del tiempo.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>6. \u00bfQui\u00e9n paga las expensas?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Los inquilinos deben abonar las expensas ordinarias, como por ejemplo, el cambio de luminaria, los gastos previsibles. El propietario paga las extraordinarias, como el arreglo y mantenimiento del edificio.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>7. \u00bfQu\u00e9 pasa si se suspenden servicios como el gas, la luz o el agua?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">El inquilino debe pagar los servicios que est\u00e1n a su cargo en tiempo y forma, pero si se suspenden por razones extraordinaria, corresponde una rebaja en el precio del alquiler. Por ejemplo, las inmobiliarias suelen alquilar viviendas a estrenar con luz de obra, y los cortes son frecuentes.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>8. \u00bfQui\u00e9n debe pagar la boleta\u00a0del ABL?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">En la ciudad de Buenos Aires, esa boleta\u00a0tiene dos impuestos: el Alumbrado, Barrido y Limpieza que est\u00e1 a cargo del inquilino, y el impuesto o tasa inmobiliaria, que lo debe pagar el propietario, seg\u00fan el art\u00edculo\u00a01.209 del C\u00f3digo Civil.\u00a0El alquiler de\u00a0vivienda \u00fanica est\u00e1 exento de IVA, por lo cual, no pueden incluir ese impuesto.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>9. \u00bfCu\u00e1ntos meses se debe pagar de dep\u00f3sito en garant\u00eda?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Es hasta un mes del valor del alquiler por a\u00f1o de contrato. Por lo tanto, ser\u00edan dos meses en un contrato de dos a\u00f1os.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\"><strong>10. \u00a0\u00bfQu\u00e9 pasa cuando se termina el contrato y se deja la vivienda?<\/strong><\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">La entrega de las llaves el paso m\u00e1s evidente, pero no el \u00fanico.\u00a0El inquilino debe pedirle al propietario o a la inmobiliaria un recibo con fecha y direcci\u00f3n del inmueble que certifique dicha entrega.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Seg\u00fan datos oficiales,\u00a0uno de cada tres hogares es alquilado en la Ciudad de Buenos Aires, esto incluye a m\u00e1s de 900.000 porte\u00f1os.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Si bien esta asociaci\u00f3n ofrece asesor\u00eda y ayuda en caso de que no haya cumplimiento por parte de las inmobiliarias, Mu\u00f1oz destac\u00f3 que hay organismos de control que existen pero no resuelven casos.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">El <strong>Colegio de Corredores de la Ciudad de Buenos Aires<\/strong> es el encargado de controlar seg\u00fan la Ley 2.340, y all\u00ed los inquilinos pueden presentar las denuncias. \u00abDesde 2007 a la fecha, no prosper\u00f3 ninguna denuncia\u00bb, acus\u00f3 Mu\u00f1oz.<\/p>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\" col-md-offset-1 col-md-10 col-xs-12 col-print-12\">\n<p class=\"element element-paragraph\">Con todo, la<strong> Defensor\u00eda del Pueblo<\/strong> tiene una Oficina de Atenci\u00f3n al Inquilino en la que aclaran, entre otras cuestiones, que el tr\u00e1mite<br \/>\nde pedido de informe de garant\u00eda\u00a0tiene una demora de cuatro d\u00edas y cuesta\u00a0$210, mientras que el express est\u00e1 en un\u00a0d\u00eda y sale 420 pesos. <em>(Infobae)<\/em><\/p>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>La falta de informaci&oacute;n junto a organismos de control que no controlan&nbsp;son las principales causas por las que la relaci&oacute;n entre el inquilino, la inmobiliaria y el propietario est&aacute; repleta de zonas grises. &iquest;Qu&eacute; est&aacute; bien y qu&eacute; esta mal? &iquest;Qu&eacute; es legal y qu&eacute; no? &iquest;D&oacute;nde empiezan los derechos del inquilino y d&oacute;nde terminan?.
