{"id":110979,"date":"2023-01-17T10:26:39","date_gmt":"2023-01-17T13:26:39","guid":{"rendered":"https:\/\/www.informelitoral.com.ar\/?p=110979"},"modified":"2023-01-17T10:27:12","modified_gmt":"2023-01-17T13:27:12","slug":"monotributo-como-apelar-las-recategorizaciones-de-oficio","status":"publish","type":"post","link":"https:\/\/informelitoral.com.ar\/monotributo-como-apelar-las-recategorizaciones-de-oficio\/","title":{"rendered":"Monotributo: c\u00f3mo apelar las recategorizaciones de oficio"},"content":{"rendered":"<p>La Administraci\u00f3n Federal de Ingresos P\u00fablicos (AFIP) modific\u00f3 la normativa correspondiente al Monotributo para facilitar la interposici\u00f3n de apelaciones ante casos de recategorizaci\u00f3n de oficio, a trav\u00e9s de la Resoluci\u00f3n General 5316\/2023 publicada en el Bolet\u00edn Oficial.<\/p>\n<p>La AFIP puede recategorizar de oficio al peque\u00f1o contribuyente cuando verifica que no cumpli\u00f3 con la obligaci\u00f3n de recategorizarse o que la misma resulte inexacta.<\/p>\n<p>Del mismo modo, el ente tributario puede recurrir a este procedimiento cuando se realizaron compras o gastos que superen el importe de ingresos brutos anuales m\u00e1ximos admitidos para la categor\u00eda en la cual se est\u00e1 encuadrado.<\/p>\n<p>Dichas recategorizaciones, en el caso de realizarse por sistemas inform\u00e1ticos, se notifican en el Domicilio Fiscal Electr\u00f3nico el primer d\u00eda h\u00e1bil de los meses de agosto y febrero de cada a\u00f1o; adem\u00e1s de ello, a trav\u00e9s del sistema web de la AFIP se puede consultar los motivos de la misma y apelarla.<\/p>\n<div class=\"embed\">\n<div class=\"inner-art\">\n<div class=\"clear\"><\/div>\n<\/div>\n<\/div>\n<p>Hasta la resoluci\u00f3n de hoy, si la recategorizaci\u00f3n fue realizada en una fiscalizaci\u00f3n presencial, el monotributista s\u00f3lo pod\u00eda apelarla por escrito ante el funcionario que dict\u00f3 la resoluci\u00f3n por la cual se efectu\u00f3 la misma.<\/p>\n<p>Desde ahora, en cambio, el contribuyente puede apelar v\u00eda web la recategor\u00edzaci\u00f3n -tanto si fue realizada presencialmente como por medios inform\u00e1ticos- a trav\u00e9s del servicio \u201cPresentaciones Digitales\u201d, seleccionado el tr\u00e1mite \u201cRecategorizaci\u00f3n de oficio del Monotributo &#8211; Apelaci\u00f3n en t\u00e9rmino\u201d dentro de los 15 d\u00edas posteriores a la notificaci\u00f3n de la recategorizaci\u00f3n.<\/p>\n<p>En caso de no presentar la apelaci\u00f3n, el monotributista quedar\u00e1 recategorizado autom\u00e1ticamente.<\/p>\n<p>El cambio de hoy busca \u201creadecuar los procedimientos vigentes para la interposici\u00f3n del recurso de apelaci\u00f3n\u201d, teniendo en cuenta \u201clos avances tecnol\u00f3gicos desarrollados\u201d y con el objetivo de \u201cfacilitar la interacci\u00f3n de dichos sujetos con los canales de comunicaci\u00f3n del organismo\u201d, se\u00f1ala la AFIP en los considerandos de la resoluci\u00f3n.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La AFIP puede recategorizar de oficio al peque\u00f1o contribuyente cuando verifica que no cumpli\u00f3 con la obligaci\u00f3n de recategorizarse o que la misma resulte inexacta.
